Umweltwirkungsschwellen nach REACH
Bestimmung, Aussagegehalt und Verbindlichkeit der PNEC-Werte
Abstract
Die Verordnung (EG) Nr. 1902/2006 zur Registrierung, Zulassung und Beschränkung chemischer Stoffe (REACH) verpflichtet die Produzenten oder Importeure registrierungspflichtiger Stoffe, die in einer Menge von mindestens 10 Tonnen pro Jahr hergestellt oder eingeführt werden, zur Bestimmung von Umweltwirkungsschwellen (PNEC-Werten) für jede schädliche Eigenschaft des zu registrierenden Stoffes. Diese geben die Konzentration eines Stoffes in einem Umweltsegment an, bei deren Überschreitung eine Beeinträchtigung der betroffenen Umweltgüter durch den Stoff nicht mehr ausgeschlossen werden kann. Die Europäische Chemikalienagentur in Helsinki ist verpflichtet, diese Werte in ihrer Datenbank zu veröffentlichen. Auf diese Datenbank können auch deutsche Behörden zugreifen und die Werte für den Vollzug des Umweltrechts nutzen. Da bei der Bestimmung der Umweltwirkungsschwellen das gesamte verfügbare Wissen über die Stoffeigenschaften zu berücksichtigen ist, sind korrekt bestimmte PNEC-Werte eine wertvolle Informationsquelle mit hohem Aussagegehalt. Unklar ist aber, welche Rechtsnatur die PNEC-Werte haben und ob sie in anderen Rechtsbereich genutzt werden können oder sogar müssen.
