On Cartels and Efficiency
Abstract
Effizienz ist Ausdruck ökonomischer Zweckrationalität und steht im Mittelpunkt vieler (mikro-) ökonomischer Analysen. Da die Mittel in einer Volkswirtschaft knapp sind, ist ökonomische Effizienz ein als wünschenswert anerkannter Zustand. Wirtschaftliche Aktivität, die Ineffizienz verursacht, ist daher zu vermeiden. Kartelle, das sind nach § 1 GWB „Vereinbarungen zwischen Unternehmen, Beschlüsse von Unternehmensvereinigungen und aufeinander abgestimmte Verhaltensweisen, die eine Verhinderung, Einschränkung oder Verfälschung des Wettbewerbs bezwecken oder bewirken“, stehen im Verdacht, Ineffizienz zu verursachen. Folgerichtig ist die Auswirkung der Kartelle auf die ökonomische Effizienz ein permanentes Motiv der Kartellforschung. Effizienz kann dabei in unterschiedlichen Bedeutungskontexten stehen. Für die Kartellforschung sind der einzelwirtschaftliche Effizienzbegriff, die Produktionseffizienz, und der gesamtwirtschaftliche Effizienzbegriff, die Allokationseffizienz, einschlägig. 1 Dem zu Grunde liegt der Gedanke, dass die durch Kartelle verursachte Ineffizienz sowohl nach unternehmensinternen als auch nach gesamtgesellschaftlichen Kriterien beurteilt werden kann (Roth 2017 S. 49). Innerhalb eines Unternehmens kann der durch die Kartellierung nachlassende Wettbewerbsdruck die Anreizstrukturen dergestalt verzerren, dass Ineffizienzen im Leistungserstellungsprozess schlicht in Kauf genommen werden. Gesamtgesellschaftlich kann die sich verändernde Marktstruktur, die Marktmacht eines Kartells, zu Ineffizienz in der Ressourcenallokation führen. Für beide Arten kartellinduzierter Ineffizienz gibt es überzeugende theoretische Argumente, die (wenige) empirische Evidenz jedoch ist uneindeutig. Die vorliegende Arbeit ist daher von der Motivation getrieben, das Verständnis für den Zusammenhang zwischen Kartellierung und ökonomischer Effizienz zu verbessern und empirische Befunde dazu vorzulegen.
