Callcenter: Mitarbeiterkontrollen auf dem datenschutzrechtlichen Prüfstand
Abstract
Callcenter spielen in der heutigen Zeit eine bedeutende Rolle in der Kundenkommunikation. Für die Betreiber der Callcenter ist dabei der Umgang mit Kundendaten selbstverständlich; dasselbe gilt oftmals in Bezug auf die Daten ihrer Mitarbeiter, die bei der Telekommunikation anfallen. Das Persönlichkeitsrecht der Arbeitnehmer schränkt den zulässigen Umgang mit solchen Daten jedoch stark ein. Der vorliegende Beitrag behandelt – insbesondere unter Berücksichtigung des seit 1. September 2009 geltenden § 32 BDSG zum Beschäftigtendatenschutz – die datenschutzrechtliche Einordnung verschiedener Maßnahmen, die Callcenter-Mitarbeiter kontrollieren und ihre Leistung sowie ihr Verhalten feststellen sollen.
